By accessing or using any service provided by Spotbookr Inc. ("Spotbookr," "we," "our," or "us") — including the Spotbookr analytics platform, the Spotsavr consumer platform, the Hermes browser extension, SBKr Indexes, the Spotbookr Media Network, the Spotbookr business products (Project Management, Scheduling, CRM and Invoicing), the Spotbookr API, the information systems we build for government agencies and other organizations, the demonstrations on our website, and any related products, services, or software (collectively, the "Services") — you ("User," "you," or "your") agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not access or use any of the Services.
Spotbookr Inc is a data company. We build and operate databases, data pipelines and reporting systems, and offer them as consumer products, advertising products, business software, and information systems for government agencies and other organizations:
We may update, enhance, modify, or discontinue any Service at our discretion with reasonable notice to affected users.
Where you or your organization has a separate written agreement with Spotbookr Inc — for example an enterprise agreement, a government contract, or a statement of work — that agreement governs the Services it covers, and prevails over these Terms where the two conflict.
You agree to:
Spotsavr is a free consumer platform. By using Spotsavr, you agree that anonymized and aggregated interaction data — including code lookups, brand follows, code shares, and platform engagement patterns — may be processed by Spotbookr's intelligence pipeline. No personally identifiable information is associated with analytics data. You may opt out of data contribution through your account settings.
Hermes is a free Chrome extension. By installing Hermes, you agree that it may:
Hermes does not track general browsing history, collect passwords or payment information, access data on non-checkout pages, or transmit personally identifiable information. You can uninstall Hermes at any time to stop all data collection.
Discount codes surfaced through Spotsavr and Hermes are sourced from publicly available creator content and affiliate networks. Spotbookr does not guarantee the validity, savings amount, or availability of any discount code. Codes may expire, have usage limits, or be restricted by the issuing brand. Spotbookr is not responsible for transactions between you and any retailer.
All intellectual property rights related to the Services — including software, algorithms, data models, indexes, user interface designs, brand identities, and documentation — remain the exclusive property of Spotbookr Inc. The Spotbookr, Spotsavr, Hermes, and SBKr Index names, logos, and service marks may not be used without prior written consent.
The Spotbookr platform software is registered with the United States Copyright Office (Registration No. TX 9-617-544). Details are on our Current Copyrights page. Names, logos and badges of other companies that appear in the Services, including those of our partner networks, belong to their respective owners.
Organizations for which we build or operate an information system retain ownership of the records they place in it, as set out in their agreement with us.
Users retain ownership of data they directly provide (e.g., uploaded campaign data for comparison). By providing feedback, suggestions, or feature requests, you grant Spotbookr a perpetual, royalty-free license to use such feedback without compensation or attribution.
Access to the Spotbookr API is subject to rate limits, usage quotas, and authentication requirements as described in our Developer Documentation. API access may be revoked if you:
Enterprise API agreements may include additional terms, SLAs, and usage rights as specified in separate written contracts.
This section applies to the Spotbookr business products: Project Management, Scheduling, CRM and Invoicing, used at work.spotbookr.com, whether taken singly, together as the Founder Starter Kit, or on the Enterprise plan.
A business account belongs to the company named at sign-up. The person who creates it is the account owner and is responsible for the people they invite, the roles they give them, and activity under the account. Each person must keep their password private. Signing in requires a one-time code sent to the person's email address.
Business products are priced per active user, for each product or for the Founder Starter Kit, and are billed monthly or yearly as you choose. The Enterprise plan is different: it is a single yearly price that covers all four products for one company of up to 10 people, it is payable for a full year in advance, and it cannot be billed monthly. A company that needs more than 10 people on the Enterprise plan must arrange this with us first. The prices that apply to you are those shown when you sign up or change your plan. Applicable taxes may be added. If we change a price, we will give at least 30 days' notice and the new price will apply from your next renewal.
New accounts on a per-user plan receive a free trial of 14 days. The Enterprise plan has no free trial: the first year is charged to your card when you subscribe, and the demonstration suite described below is available for trying the products first.
For per-user plans: A valid payment card is required to start the trial. Nothing is charged during the trial. Unless you cancel before the trial ends, your card will be charged for the plan you selected on the date shown at sign-up, and your subscription will begin. Each company may have one free trial.
Subscriptions renew automatically at the end of each billing period, monthly or yearly, until cancelled. On a per-user plan, each active person on your account is one paid seat. When you add a person or a product during a billing period, the charge for the rest of that period is invoiced and charged to your card at the time of the change; during a free trial nothing is charged, and the added seat is included in the first charge when the trial ends. When you remove a person or a product, the unused part of the period is credited against your next invoice. Payments for your Spotbookr subscription are processed by Stripe; we do not receive or store your full card number. Payments that your own customers make to you are covered separately, under "Card Payments on Your Invoices" below.
You can cancel at any time from Plans and billing in your account. If you cancel during the free trial, you are not charged. If you cancel after a paid period has started, your products stay available until the end of that period and the subscription does not renew. Except where the law requires otherwise, payments are not refunded for a period that has already begun.
If a payment cannot be collected, we will notify the account owner and may suspend access to the affected products until payment is made. Your data is kept during a suspension.
The records you and your team enter into the business products, including projects, tasks, comments, files you attach, contacts, deals, bookings, customers and invoices, belong to your company. We use them only to provide the Services to you. We do not sell them and do not use them in our advertising intelligence products or indexes. You can export your data at any time. After a subscription ends, we keep your data for 90 days so you can return or export it, after which it may be deleted.
Some features involve people outside your company, such as the public booking page, booking confirmations, invoices and payment reminders. You are responsible for having the right to hold and use the information you enter about those people, for the accuracy of what is sent to them in your name, and for complying with the laws that apply to your business, including those on privacy and unsolicited messages.
The business products are tools. Invoicing does not provide accounting, tax or legal advice; you are responsible for your tax rates, the content of your invoices and your own records. Forecasts and reports are calculated from the information you enter.
What the feature is. Invoicing includes an optional feature that lets your customers pay an invoice by card. To use it you connect your own Stripe account to your Spotbookr account. Payments are processed by Stripe, Inc. and its affiliates ("Stripe"), not by Spotbookr. Your use of Stripe is governed by your own agreement with Stripe, including the Stripe Connected Account Agreement and the Stripe Services Agreement, and by connecting your account you confirm that you accept them. If you do not connect a Stripe account, this subsection does not apply to you.
Where the money goes. When your customer pays, the payment is made to you. Stripe settles the funds to your own Stripe account and pays them out to your bank account on Stripe's schedule. Spotbookr does not receive, hold, control or transmit your customers' funds at any point. Spotbookr is not a bank, a payment processor, a money transmitter or a money services business, and is not a party to the transaction between you and your customer. You are the seller and the merchant of record for every payment.
Our fee. For each successful card payment made through this feature, Spotbookr charges a fee of 0.5% of the amount paid plus $0.25. Stripe deducts this fee from the payment and pays it to Spotbookr; the rest is settled to you. This fee is in addition to the processing fees that Stripe charges you under your agreement with Stripe, and in addition to your subscription. Invoices paid by any other method carry no fee from us. If you refund a payment, in whole or in part, our fee for that payment is not returned, except where the law requires otherwise. If we change this fee we will give you at least 30 days' notice, and the new fee will apply to payments made after the notice period.
What you are responsible for. You are responsible for the goods and services you sell and for everything connected with each sale, including: the accuracy of your invoices and estimates; your prices, taxes and the collection and remittance of any sales or other tax; your refund and cancellation terms; customer service; and compliance with the laws and card network rules that apply to your business. You must not use the feature for any business or activity that Stripe prohibits or restricts, or for anything unlawful or fraudulent. Refunds, disputes and chargebacks are handled between you, your customer and Stripe, through your Stripe account. You are liable for all refunds, chargebacks, reversals, fines and negative balances arising from your payments, and Spotbookr is not.
Card and payment information. Card details are entered on a page hosted by Stripe and are never received or stored by Spotbookr. We receive from Stripe only what is needed to keep your records right: that a payment succeeded, its amount, the time, and reference numbers for the payment and for your Stripe account. We record this against the invoice so that it shows as paid.
Availability and suspension. The feature currently supports payments in US dollars and depends on Stripe's services, which we do not control; we do not guarantee that it will be available without interruption. We may suspend or switch off the feature for your account, with notice where that is practical, if we reasonably believe it is being used in breach of these terms, for fraud, or in a way that exposes you, your customers, Stripe or Spotbookr to harm, or if Stripe requires us to. You can disconnect your Stripe account from Spotbookr at any time in Invoicing settings; this does not close your Stripe account.
No liability for the underlying transaction. To the fullest extent the law allows, Spotbookr is not liable for any loss arising from a transaction between you and your customer, from Stripe's acts or omissions, or from a payment that fails, is delayed, is reversed or is disputed. Nothing in this subsection limits the other limits of liability in these Terms.
You can send an estimate that your customer accepts or declines on a private web page by typing their name. We record the name entered, the date and time, and the estimate as it stood. The estimate, its terms and any contract it creates are between you and your customer. Spotbookr is not a party to it, gives no assurance that an online acceptance will be legally binding in your circumstances, and does not verify the identity of the person who accepts. If you need a signed contract, use one.
Invoicing lets you save the products and services you sell with their prices, apply discounts to a line or to a whole invoice or estimate, set a tax rate, and mark items on which no tax is charged. These are your settings and your decisions. Spotbookr adds up what you enter: it applies your discounts and then your tax rate to the lines you have marked as taxed. We do not decide whether something is taxable, what rate applies where you or your customer are located, or whether a discount or price is lawful, and nothing in the product is tax, accounting or legal advice. You are responsible for checking each invoice and estimate before you send it, and for charging, collecting, reporting and remitting the correct tax.
You can upload a logo and add your company details, notes and a footer, which we display to your customers on your invoices and estimates, on the private web pages we host for them and in the PDF copies. You confirm that you have the right to use everything you upload or enter, including any trademark in your logo, and you give Spotbookr permission to store, resize and display it for that purpose only. Your logo is served from a web address that does not require a sign-in, so that your customers can see it; do not upload an image you would not show a customer. Do not include content that is unlawful, misleading or that impersonates another business. A private memo on an invoice or estimate is visible to the people on your account and is not shown on the customer's page or PDF; it remains part of your account data and is included in an export of your data.
You can direct Spotbookr to send information about events in your account to other services, such as a Slack channel or a web address you provide, and you can create keys that allow other services to add records to your account. When you do so, you are instructing us to share that information with the service you choose, and its handling of the information is governed by your agreement with that service, not by us. Keep your keys and signing secrets confidential, revoke any that may have been exposed, and do not send data to a destination you are not entitled to share it with. Booking confirmations, reminders and similar messages are sent to your customers on your behalf and at your direction.
Project Management can carry out actions for you under rules that you or your team switch on, such as moving, assigning or labelling work, and completing or starting sprints on a schedule. These actions are taken on your instruction and you are responsible for the rules you set. The product sends notices to the people on your account, in the product and by email, about work that involves them; each person can choose how often they receive these emails or switch them off. Files you attach are stored with your account and are subject to the size and storage limits shown in the product; do not upload anything you do not have the right to store or share. A client link is a private web address that shows a read-only view of a project's progress to anyone who has the address. You decide who receives it, you can replace it or switch it off at any time, and you are responsible for what it shows.
We offer a demonstration version of the business products that is filled with fictional example data. To open it we ask only for an email address. A demonstration is private to the person who opened it, is temporary, and is not a subscription: anything entered in it is erased when you sign out, and in any case within a few hours, and cannot be recovered or moved to a paid account. Billing, invitations and outgoing email are switched off inside a demonstration. Please do not enter real personal, confidential or business-critical information in it. We keep the email address you give us so that we can contact you about our products; you can ask us to remove it at any time by writing to support@spotbookr.com.
Spotbookr offers free tools on spotbookr.com, starting with Free Document Signing and Verify a Document. They are provided free of charge, as they are, without any warranty, and we may change, limit or withdraw them at any time. You open Free Document Signing by confirming your email address with a code we send you.
Free Document Signing. The tool runs in your web browser. The document you open, the signature and initials you create, and anything you type are processed on your own device and are not sent to or stored by Spotbookr; because of that we cannot recover a document for you, and you should download your finished copy before you leave the page. When you finish, you state that you intend to sign, and the tool adds a certificate page to the document showing your name, your confirmed email address, the date and time, a reference, and a fingerprint of the original file. We keep a record of the signing: the reference, your name and email address, the time, the name of the file, and fingerprints of the original and finished files. A fingerprint is a code calculated from a file that identifies it without revealing its contents.
What a signature made here is. In the United States, the federal ESIGN Act and state laws such as the Uniform Electronic Transactions Act provide that a signature may not be denied legal effect solely because it is electronic, and a signature placed with this tool is an electronic signature of that kind. Some documents are excluded from those laws or need further formalities, including wills and testamentary trusts, certain family-law and court documents, and certain official notices; other countries apply their own rules. Spotbookr confirms only that the signer controlled the email address shown on the certificate. We do not check identity documents, we do not act as a witness or notary, and the tool does not apply a cryptographic certificate or provide a qualified or advanced electronic signature under European rules. Whether a particular document is valid or enforceable is for you and the other party to determine, and nothing in the tool is legal advice. You are responsible for having the right to sign and alter any document you use, and you must not use the tool to sign in another person's name without their authority or to falsify a document.
Verify a Document. Anyone who holds a file can check it against our records. The check is made with the file's fingerprint; the file is not uploaded. A match means the file is identical to one registered at signing and shows the signer's name, confirmed email address, the time and the reference. No match means the file was not signed with the tool or has changed since. By signing with the tool you agree that anyone holding your signed file can see those details. We aim to keep signing records available but do not guarantee that a record will be kept for any particular period, so keep your own signed copy.
To the maximum extent permitted by law, Spotbookr Inc is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. This includes, but is not limited to, damages arising from: data inaccuracies, model prediction errors, service interruptions, expired discount codes, third-party retailer disputes, or unauthorized access to your account.
Our total aggregate liability for any claims arising from the Services is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD. The Services are provided "as is" and "as available" without warranties of any kind.
You may terminate your use of any Service at any time. For Spotsavr, delete your account through account settings. For Hermes, uninstall the extension. For the business products, cancel from Plans and billing in your account (see Section 7). For Spotbookr platform accounts, contact support@spotbookr.com.
We may suspend or terminate your access to any Service if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your right to use the Services ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.
Except where a separate written agreement applies as described in Section 2, these Terms constitute the entire agreement between you and Spotbookr Inc regarding the Services. If any provision is found invalid, the remaining provisions continue in full force. Our failure to enforce any right does not waive future enforcement.
These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved in the courts of Kent County, Delaware. You may not assign your rights under these Terms without written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
How Spotbookr Inc collects, uses, stores, shares, and protects personal and usage information across all Services.

Spotbookr Inc collects different categories of information depending on which Services you use:
When you create a Spotbookr account: email address, username, password (stored as a cryptographic hash), full name, company name, job title, phone number, and billing address.
When you create a Spotsavr account: email address, username, password (hashed), and optionally your display name and followed brands.
Hermes requires a Spotsavr account. Data collected by Hermes is limited to checkout-page interactions and includes:
Hermes does not collect: browsing history outside of checkout pages, passwords, payment card numbers, or data from non-checkout pages.
Payments are processed by Stripe, Inc. We store your Stripe Customer ID and billing address but never store complete credit card numbers. Stripe handles all payment data under PCI-DSS standards.
Upon login to any Service, we collect: IP address, browser user agent, login timestamp, session duration, and authentication status. Login attempts (successful and failed) are logged for security monitoring.
Activity within the Services including: search queries, feature usage patterns, dashboard interactions, API calls, report generation, and session flow data.
With your consent (managed through our cookie consent system), we use Google Analytics to collect usage statistics. Our consent manager allows granular control over analytics, functional, and marketing cookies. Consent preferences are stored locally and respected across all Services.
When you register as a creator or brand in the Media Network: the contact details you provide, links to your social media profiles or company, and the information needed to track referrals and pay commissions.
When you contact us, including about enterprise services or a public solicitation: your name, organization, contact details and the content of your message.
The demonstrations on our website keep what you enter in your own browser's local storage. That information is not transmitted to or stored on our servers, and you can clear it with the "Reset demo data" control.
When you create a business account: your company name, your name, work email, password (stored as a cryptographic hash), and optionally your phone number, company website and team size. For billing we hold your billing name and address and a reference to your customer record at Stripe. Card details are entered directly with Stripe and are not stored on our servers.
When you use Free Document Signing, we collect the email address you confirm, which tool you used, and when. Each time you sign a document we also record the name you sign with, the time, your time zone, the name of the file, the number of pages, a summary of what you added (for example "1 signature, 1 date"), fingerprints of the original and finished files, and the internet address and browser type used. A fingerprint is a code calculated from a file; it identifies the file without revealing its contents and cannot be turned back into the document. We use this to provide the signing certificate and the Verify a Document check, to prevent misuse, and to tell you about Spotbookr products; every marketing email includes a way to unsubscribe. A confirmation of your email address is remembered in your own browser for up to 30 days so you are not asked for a code each time.
We do not receive the documents you open, your signature, your initials or anything you type into a document: these are handled entirely in your browser and never reach our servers. Anyone who holds a file you signed can use Verify a Document to see your name, your confirmed email address, the time of signing and the reference; these are the same details printed on the certificate page inside the file. Your internet address and browser type are not shown to them. To ask us to delete a signing record, write to support@spotbookr.com; once a record is deleted the document can no longer be verified.
The business products store what you and your team enter, which can include information about your own customers and contacts, such as names, email addresses, appointments and invoices. We hold this information on your behalf, to provide the service to you. Your company decides what is collected and is responsible for it; requests from those individuals about their information should be directed to your company, and we will assist you in responding.
We share data with: Stripe (payment processing and subscription billing), Google Analytics (with consent, usage analytics), our own email infrastructure together with Brevo (delivery of transactional emails), affiliate and partnership networks such as Awin and PartnerStack (tracking of referrals and commissions for the Media Network and Spotsavr), and the cloud infrastructure providers that host our systems. We do not sell personal information to any third party.
SBKr Index data is published publicly as part of our research mission. Index data is fully aggregated and derived from advertising platform data, not individual consumer behavior.
We may disclose information in response to subpoenas, court orders, or legal processes; to comply with applicable laws; to protect our rights, property, and safety; or to investigate security issues.
In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity with advance notice.
In the event of a data breach affecting your personal information, we will notify affected users via email within 72 hours of confirmed discovery, providing details about: the nature and scope of the breach, categories of data affected, remedial steps taken, and recommended user actions.
You can access your account data through your dashboard. For a complete data export in machine-readable format, contact privacy@spotbookr.com. We will respond within 30 days.
Update profile information through your account settings. For changes to email or critical account data, contact support for verification.
Request deletion by contacting support@spotbookr.com. Upon verification we will: cancel active subscriptions, terminate sessions, delete account data within 90 days, remove Stripe payment methods, anonymize activity records, and retain only legally required records (billing for tax purposes).
You can opt out of contributing anonymized data to Spotbookr through your Spotsavr account settings. Opting out does not affect your ability to use Spotsavr for finding and applying discount codes.
Uninstalling the Hermes extension immediately stops all checkout signal collection. You can also disable specific data collection features through the extension's settings popup without uninstalling.
Manage cookie and analytics preferences through our consent manager (accessible on first visit and via "Cookie Settings" in the footer). Settings are stored locally and must be configured per device/browser.
Opt out of marketing emails via the unsubscribe link in any message. Transactional emails (account confirmation, security alerts, password resets) cannot be disabled as they are essential to service operation.
California residents have the right to: know what personal information is collected, request deletion, and opt out of sale of personal information. We do not sell personal information. To exercise CCPA rights, contact privacy@spotbookr.com.
EU/EEA residents have additional rights including: right of access, rectification, erasure, restriction of processing, data portability, and objection. Our lawful bases for processing include: consent (analytics), contract performance (account services), and legitimate interests (security, product improvement). Contact our privacy team to exercise these rights.
Spotbookr Inc is based in the United States. Data is primarily stored and processed on U.S.-based servers. For users outside the United States:
We may update this Privacy Policy to reflect changes in our practices, products, or legal requirements. For material changes, we will: post the updated policy with a new "Last Updated" date, send email notification to registered users, display a notice within the Services, and provide at least 30 days notice before changes take effect. Continued use after the effective date constitutes acceptance.
How Spotbookr Inc collects, aggregates, models, and distributes advertising and consumer intelligence data across the Spotbookr ecosystem.

This Data Policy governs how Spotbookr Inc collects, processes, models, and distributes data across the Spotbookr ecosystem. It applies to all data processed through the Spotbookr platform, Spotsavr, Hermes, SBKr Indexes, the Media Network, and the Spotbookr API.
Records that customers keep in the business products (Project Management, Scheduling, CRM and Invoicing) are also outside this Data Policy: they belong to the customer and are not used in Spotbookr's intelligence pipeline, indexes or advertising products.
Records held in an information system that we build or operate for a government agency or other client are outside this Data Policy. They belong to the client, are handled only as that client's agreement directs, and are not used in Spotbookr's intelligence pipeline, indexes or commercial products.
Central to our Services is the aggregation, processing, and analysis of data from multiple sources to produce advertising and consumer intelligence. You acknowledge and agree that Spotbookr operates as a data intelligence company and that data processing is fundamental to the Services we provide.
We collect publicly available advertising data from platform ad libraries and transparency tools, including: Meta Ad Library (Facebook, Instagram, Messenger, Audience Network), Google Ads Transparency Center (Search, YouTube, Display, Maps), TikTok Commercial Content Library, and additional platforms. Data includes: ad creatives, copy, targeting parameters, "paid for by" disclosures, placement data, format breakdowns, and estimated reach. This data is publicly available and is not linked to individual user accounts.
Anonymized behavioral signals from Spotsavr and Hermes including: code interaction data, brand engagement signals, checkout patterns, discount redemption rates, and spending behavior indicators. See Section 20 for detailed consumer signal processing practices.
Where applicable, we incorporate data from third-party partnerships, public research datasets, and industry benchmarks to supplement and validate our intelligence outputs.
When you use Spotsavr, the following anonymized and aggregated data feeds into Spotbookr's analytics engine:
Hermes checkout signals represent a key consumer data stream in our pipeline:
Spotbookr aggregates data from public ad libraries, consumer interaction signals from Spotsavr and Hermes, third-party data partnerships, and proprietary research to produce comprehensive advertising intelligence.
Our ML pipeline correlates advertising campaign data with consumer behavior signals to produce insights such as: which ad campaigns correlate with purchasing activity, creative effectiveness signals, brand-level conversion indicators, and market trend detection. These correlations operate on aggregated, anonymized datasets.
Our value proposition includes correlating advertising campaign data with anonymized consumer behavior signals from Spotsavr and Hermes. This creates a system where ad exposure can be correlated with aggregated purchasing behavior patterns. Individual-level tracking is never performed.
We apply machine learning models, statistical analysis, and proprietary algorithms to produce: spend estimates, performance predictions, trend detection, creative scoring, sentiment analysis, and anomaly identification. Model outputs are estimates subject to inherent uncertainty and are not guaranteed facts.
SBKr Indexes are computed from aggregated advertising data using multi-timeframe analysis, growth indicators, quality adjustments, and statistical normalization. Index methodologies are documented on our SBKr Indexes page.
Spotbookr platform users and enterprise clients receive intelligence products containing aggregated and modeled data derived from multiple sources. These outputs cannot be used to identify individual consumers. Enterprise clients receive intelligence outputs, not raw consumer data.
Intelligence outputs distributed through the Spotbookr API are subject to the same aggregation and anonymization standards. API consumers receive processed intelligence, not raw source data.
SBKr Index data and select research outputs are published publicly as part of our mission to make advertising markets transparent. All public outputs are fully aggregated.
All consumer data from Spotsavr and Hermes is anonymized before entering Spotbookr's intelligence pipeline. Specifically:
