By accessing or using any service provided by Spotbookr Inc. ("Spotbookr," "we," "our," or "us") — including the Spotbookr analytics platform, the Spotsavr consumer platform, the Hermes browser extension, SBKr Indexes, the Spotbookr API, and any related products, services, or software (collectively, the "Services") — you ("User," "you," or "your") agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not access or use any of the Services.
Spotbookr Inc operates an integrated ecosystem of consumer analytics, advertising intelligence, and data modeling products:

Spotsavr is a free consumer platform. By using Spotsavr, you agree that anonymized and aggregated interaction data — including code lookups, brand follows, code shares, and platform engagement patterns — may be processed by Spotbookr's intelligence pipeline. No personally identifiable information is associated with analytics data. You may opt out of data contribution through your account settings.
Hermes is a free Chrome extension. By installing Hermes, you agree that it may:
Hermes does not track general browsing history, collect passwords or payment information, access data on non-checkout pages, or transmit personally identifiable information. You can uninstall Hermes at any time to stop all data collection.
Discount codes surfaced through Spotsavr and Hermes are sourced from publicly available creator content and affiliate networks. Spotbookr does not guarantee the validity, savings amount, or availability of any discount code. Codes may expire, have usage limits, or be restricted by the issuing brand. Spotbookr is not responsible for transactions between you and any retailer.
All intellectual property rights related to the Services — including software, algorithms, data models, indexes, user interface designs, brand identities, and documentation — remain the exclusive property of Spotbookr Inc. The Spotbookr, Spotsavr, Hermes, and SBKr Index names, logos, and service marks may not be used without prior written consent.
Users retain ownership of data they directly provide (e.g., uploaded campaign data for comparison). By providing feedback, suggestions, or feature requests, you grant Spotbookr a perpetual, royalty-free license to use such feedback without compensation or attribution.
Access to the Spotbookr API is subject to rate limits, usage quotas, and authentication requirements as described in our Developer Documentation. API access may be revoked if you:
Enterprise API agreements may include additional terms, SLAs, and usage rights as specified in separate written contracts.
To the maximum extent permitted by law, Spotbookr Inc is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. This includes, but is not limited to, damages arising from: data inaccuracies, model prediction errors, service interruptions, expired discount codes, third-party retailer disputes, or unauthorized access to your account.
Our total aggregate liability for any claims arising from the Services is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD. The Services are provided "as is" and "as available" without warranties of any kind.
You may terminate your use of any Service at any time. For Spotsavr, delete your account through account settings. For Hermes, uninstall the extension. For Spotbookr platform accounts, contact admin@spotbookr.com.
We may suspend or terminate your access to any Service if you violate these Terms, engage in abusive behavior, or if required by law. Upon termination, your right to use the Services ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and dispute resolution survive termination.
These Terms constitute the entire agreement between you and Spotbookr Inc regarding the Services. If any provision is found invalid, the remaining provisions continue in full force. Our failure to enforce any right does not waive future enforcement.
These Terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved in the courts of Kent County, Delaware. You may not assign your rights under these Terms without written consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.
How Spotbookr Inc collects, uses, stores, shares, and protects personal and usage information across all Services.

Spotbookr Inc collects different categories of information depending on which Services you use:
When you create a Spotbookr account: email address, username, password (stored as a cryptographic hash), full name, company name, job title, phone number, and billing address.
When you create a Spotsavr account: email address, username, password (hashed), and optionally your display name and followed brands.
Hermes requires a Spotsavr account. Data collected by Hermes is limited to checkout-page interactions and includes:
Hermes does not collect: browsing history outside of checkout pages, passwords, payment card numbers, or data from non-checkout pages.
Payments are processed by Stripe, Inc. We store your Stripe Customer ID and billing address but never store complete credit card numbers. Stripe handles all payment data under PCI-DSS standards.
Upon login to any Service, we collect: IP address, browser user agent, login timestamp, session duration, and authentication status. Login attempts (successful and failed) are logged for security monitoring.
Activity within the Services including: search queries, feature usage patterns, dashboard interactions, API calls, report generation, and session flow data.
With your consent (managed through our cookie consent system), we use Google Analytics to collect usage statistics. Our consent manager allows granular control over analytics, functional, and marketing cookies. Consent preferences are stored locally and respected across all Services.
We share data with: Stripe (payment processing), Google Analytics (with consent, usage analytics), and our own email infrastructure (transactional emails via Postfix SMTP). We do not sell personal information to any third party.
SBKr Index data is published publicly as part of our research mission. Index data is fully aggregated and derived from advertising platform data, not individual consumer behavior.
We may disclose information in response to subpoenas, court orders, or legal processes; to comply with applicable laws; to protect our rights, property, and safety; or to investigate security issues.
In the event of a merger, acquisition, or sale of assets, your information may be transferred to the acquiring entity with advance notice.
In the event of a data breach affecting your personal information, we will notify affected users via email within 72 hours of confirmed discovery, providing details about: the nature and scope of the breach, categories of data affected, remedial steps taken, and recommended user actions.
You can access your account data through your dashboard. For a complete data export in machine-readable format, contact privacy@spotbookr.com. We will respond within 30 days.
Update profile information through your account settings. For changes to email or critical account data, contact support for verification.
Request deletion by contacting admin@spotbookr.com. Upon verification we will: cancel active subscriptions, terminate sessions, delete account data within 90 days, remove Stripe payment methods, anonymize activity records, and retain only legally required records (billing for tax purposes).
You can opt out of contributing anonymized data to Spotbookr through your Spotsavr account settings. Opting out does not affect your ability to use Spotsavr for finding and applying discount codes.
Uninstalling the Hermes extension immediately stops all checkout signal collection. You can also disable specific data collection features through the extension's settings popup without uninstalling.
Manage cookie and analytics preferences through our consent manager (accessible on first visit and via "Cookie Settings" in the footer). Settings are stored locally and must be configured per device/browser.
Opt out of marketing emails via the unsubscribe link in any message. Transactional emails (account confirmation, security alerts, password resets) cannot be disabled as they are essential to service operation.
California residents have the right to: know what personal information is collected, request deletion, and opt out of sale of personal information. We do not sell personal information. To exercise CCPA rights, contact privacy@spotbookr.com.
EU/EEA residents have additional rights including: right of access, rectification, erasure, restriction of processing, data portability, and objection. Our lawful bases for processing include: consent (analytics), contract performance (account services), and legitimate interests (security, product improvement). Spotbookr Inc is based in the United States. Data is primarily stored and processed on U.S.-based servers. For users outside the United States:
We may update this Privacy Policy to reflect changes in our practices, products, or legal requirements. For material changes, we will: post the updated policy with a new "Last Updated" date, send email notification to registered users, display a notice within the Services, and provide at least 30 days notice before changes take effect. Continued use after the effective date constitutes acceptance.

This Data Policy governs how Spotbookr Inc collects, processes, models, and distributes data across the Spotbookr ecosystem. It applies to all data processed through the Spotbookr platform, Spotsavr, Hermes, SBKr Indexes, and the Spotbookr API.
Central to our Services is the aggregation, processing, and analysis of data from multiple sources to produce advertising and consumer intelligence. You acknowledge and agree that Spotbookr operates as a data intelligence company and that data processing is fundamental to the Services we provide.
We collect publicly available advertising data from platform ad libraries and transparency tools, including: Meta Ad Library (Facebook, Instagram, Messenger, Audience Network), Google Ads Transparency Center (Search, YouTube, Display, Maps), TikTok Commercial Content Library, and additional platforms. Data includes: ad creatives, copy, targeting parameters, "paid for by" disclosures, placement data, format breakdowns, and estimated reach. This data is publicly available and is not linked to individual user accounts.
Anonymized behavioral signals from Spotsavr and Hermes including: code interaction data, brand engagement signals, checkout patterns, discount redemption rates, and spending behavior indicators. See Section 19 for detailed consumer signal processing practices.
Where applicable, we incorporate data from third-party partnerships, public research datasets, and industry benchmarks to supplement and validate our intelligence outputs.

Spotbookr aggregates data from public ad libraries, consumer interaction signals from Spotsavr and Hermes, third-party data partnerships, and proprietary research to produce comprehensive advertising intelligence.
Our ML pipeline correlates advertising campaign data with consumer behavior signals to produce insights such as: which ad campaigns correlate with purchasing activity, creative effectiveness signals, brand-level conversion indicators, and market trend detection. These correlations operate on aggregated, anonymized datasets.
Our value proposition includes correlating advertising campaign data with anonymized consumer behavior signals from Spotsavr and Hermes. This creates a system where ad exposure can be correlated with aggregated purchasing behavior patterns. Individual-level tracking is never performed.
We apply machine learning models, statistical analysis, and proprietary algorithms to produce: spend estimates, performance predictions, trend detection, creative scoring, sentiment analysis, and anomaly identification. Model outputs are estimates subject to inherent uncertainty and are not guaranteed facts.
SBKr Indexes are computed from aggregated advertising data using multi-timeframe analysis, growth indicators, quality adjustments, and statistical normalization. Index methodologies are documented on our SBKr Indexes page.
Spotbookr platform users and enterprise clients receive intelligence products containing aggregated and modeled data derived from multiple sources. These outputs cannot be used to identify individual consumers. Enterprise clients receive intelligence outputs, not raw consumer data.
Intelligence outputs distributed through the Spotbookr API are subject to the same aggregation and anonymization standards. API consumers receive processed intelligence, not raw source data.
SBKr Index data and select research outputs are published publicly as part of our mission to make advertising markets transparent. All public outputs are fully aggregated.

Spotbookr Inc provides advertising intelligence, consumer analytics, spend estimates, performance predictions, market indexes, creative scores, and other data outputs (collectively, "Intelligence Outputs") generated through proprietary algorithms, machine learning models, statistical analysis, and multi-source data aggregation.
All Intelligence Outputs are estimates, models, and approximations — not verified facts. They are produced by automated systems processing large volumes of data from multiple sources, each of which may contain errors, gaps, delays, or inconsistencies. No representation or warranty is made, express or implied, as to the accuracy, completeness, timeliness, or reliability of any Intelligence Output.

Users are solely responsible for how they interpret, apply, and act upon Intelligence Outputs. Spotbookr strongly recommends that users validate Intelligence Outputs against independent sources and exercise professional judgment before making business decisions based on our data.
Significant portions of Spotbookr's Intelligence Outputs depend on data sourced from third-party platforms including Meta, Google, TikTok, and others. Spotbookr has no control over and assumes no responsibility for:
If a third-party data source becomes unavailable, restricted, or unreliable, affected Intelligence Outputs may be degraded, delayed, or temporarily unavailable without liability to Spotbookr.
You agree to indemnify, defend, and hold harmless Spotbookr Inc, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:
The algorithms, models, data processing pipelines, scoring methodologies, index computation methods, and analytical frameworks used by Spotbookr Inc constitute proprietary trade secrets and confidential business information. You agree that:

You use all Intelligence Outputs at your own risk. Spotbookr's data products are tools for analysis and research — not definitive statements of fact. The burden of verification rests with the user.
